1. GENERAL PROVISIONS

AirportBlacklane, owned and operated by Platinum Consulting Group Inc., located at 5638 Northton Ct, Woodbridge, VA 22193, USA (hereinafter referred to as "AirportBlacklane"), provides users with a platform to book transportation services. This is facilitated through its proprietary online platform and integrated third-party platforms, including mobile applications ("apps"; collectively referred to as "AB Tools"). AirportBlacklane’s role is to arrange transportation services by connecting users with independent ride service providers (Transportation Service Providers or "TSPs"). However, AirportBlacklane itself does not provide the transportation services directly.

These General Terms and Conditions (hereinafter referred to as "T&Cs") govern every agreement between the user and Airportblacklane regarding the arrangement of transportation services. They also outline the user’s rights to make claims directly against the designated TSP providing the service.

Any conflicting terms and conditions proposed by the user, including those referenced in confirmation letters or implied through unconditional acceptance of services, are expressly rejected. Exceptions to this policy apply only if explicitly approved in writing by the management of Airportblacklane.

2. CONTRACTUAL RELATIONSHIP AND CONTRACT CONCLUSION

2.1 CONTRACTUAL RELATIONSHIP

Airportblacklane does not directly provide transportation services through the AB Tools, nor does it act as a third-party agent for such services. Instead, Airportblacklane facilitates a contractual relationship between the user and an independent Transportation Service Provider (TSP), granting the user a direct claim for transportation services against the TSP.

To enable this, Airportblacklane enters into agreements with TSPs on its own behalf, ensuring that the user has a valid claim for transportation services ("contract for the benefit of third parties," also referred to as a "transportation contract for the benefit of the user"). Based on this arrangement, the user has the right to request transportation services and make any associated claims directly with the designated TSP.

The agreement between Airportblacklane and the user pertains solely to the facilitation of a business service contract, not the provision of actual transportation services. Airportblacklane's compensation covers both the arrangement of business services and the payment allocated to the TSP for the transportation services provided.

2.2 CONCLUSION OF CONTRACT

By submitting a completed booking form via the AB Tools or making arrangements by telephone with Airportblacklane, the user submits an offer to enter into a business service contract (“ride request”). The subject of this contract is the facilitation of the requested ride service.

Initially, Airportblacklane sends the user an email confirming receipt of the ride request, outlining the details of the requested ride service. This confirmation solely acknowledges the receipt of the user’s request and does not constitute a binding agreement.

The business service contract between Airportblacklane and the user is only concluded upon a separate confirmation (“booking confirmation”) sent via email by Airportblacklane. Upon receipt of this confirmation, the user gains a direct entitlement against the designated TSP to request the ride service and assert any related claims directly with the TSP.

3. REGISTRATION OBLIGATION OF THE USER FOR THE USE OF THE AB TOOLS

The user guarantees to Airportblacklane that all information provided, whether directly or through a third party acting on their behalf, is complete and accurate. Registrations made through automated processes are strictly prohibited.

4. SELECTED CONTENT OF THE TRANSPORTATION CONTRACT FOR THE BENEFIT OF THE USER

The user may request details of a ride request as described in Section 4 from the TSP only if this has been agreed upon with Airportblacklane in the business service contract.

The following conditions apply to the user's direct claim for transportation against the TSP, which is procured by Airportblacklane:

4.1 RIDE TYPES, SERVICE CHANGES

Depending on local availability, the user can select from transfer rides, long-distance rides (starting at 200 km), on-demand rides (“chauffeur hailing”), and hourly bookings.

If the actual ride requires additional effort due to user or guest requests differing from the initial ride request, the TSP will accommodate these requests if possible. Additional costs may apply, as outlined in Section 5.

Subject to availability, users may request changes to the ride after the contract is concluded. Additional charges may apply as described in Section 5.2.

4.1.1

For transfer, long-distance, and on-demand rides, the displayed price is based on a start and destination address. Additional stopovers may incur extra fees per the applicable pricing schedule (see Section 5).

4.1.2

Hourly bookings start at the scheduled pickup time and end within the city area of the pickup location. If a user requests completion of the ride outside this area or exceeds the booked kilometers or duration, additional fees may apply, particularly due to the return trip to the pickup location.

4.2 PICKUP TIME

The agreed pickup time is as specified in the Airportblacklane booking confirmation.

For airport or long-distance train station pickups where a correct flight or train number has been provided, Airportblacklane will adjust the pickup time if delays occur.

4.3 VEHICLE CLASS/VEHICLE MODEL, UPGRADE

Users can choose from different vehicle classes based on regional availability (e.g., “Business Class,” “Business Van/SUV,” “First Class,” “Sprinter Class,” or “Electric Class”).

Displayed vehicles in the Airportblacklane tools are illustrative only; specific models are not guaranteed. Regional differences apply.

Airportblacklane may upgrade a “Business Class” booking to a higher class (e.g., “Business Van” or “First Class”) at no extra cost, subject to availability.

4.4 TRANSPORT SAFETY, CONSEQUENCES

4.4.1 LUGGAGE, ANIMALS

The booking confirmation includes the specified number of luggage pieces.

Excess or bulky luggage (e.g., wheelchairs), weapons, or animals must be specified during booking. The TSP may refuse transport for unlisted items, particularly if animals are not in appropriate transport boxes. Exceptions apply if local laws require accommodation.

If the TSP allows transport of unlisted items, additional charges may apply, increasing the total business service contract cost (see Section 5).

4.4.2 TRANSPORT OF CHILDREN AND MINORS

(A) Children: The user must specify child restraints needed, including the number and age of children, when making the ride request.

(B) Minors: The TSP may refuse to transport unaccompanied minors, as determined by local legal requirements.

4.4.3 INFORMATION ON PASSENGERS AND LUGGAGE

Airportblacklane provides vehicle-specific limits on passengers and luggage in a binding policy. The TSP may refuse transport if capacity and safety constraints are exceeded.

4.4.4 IMPEDED TRANSPORT

The TSP may refuse transport if required details (per Section 4.3) were not provided or incorrectly provided.

If transport is denied for this reason, Airportblacklane retains the right to compensation under the business service contract.

4.5 DELAYS

Events such as strikes, extreme weather, or other disruptions may lead to longer wait times or cancellations, which the user must accept.

4.6 CANCELLATIONS, REBOOKINGS, AND NO-SHOW RIDES

4.6.1 CANCELLATION

Transfer, long-distance, and hourly bookings can be canceled for free if more than one hour remains before the agreed pickup time.

Cancellations within one hour of the pickup time require full payment. Users must cancel via the website or app.

4.6.2 REBOOKINGS

Rebookings are treated as new bookings. The cancellation terms (Section 4.6.1) apply to the original booking, and Airportblacklane may still claim compensation for it.

4.6.3 NO-SHOW RIDES WITHOUT CANCELLATION, USER DELAY

A “no-show” voids the user's transport claim but does not void Airportblacklane’s right to compensation.

(A) Transfer and Long-Distance Rides: A ride is considered a no-show if the user or guest does not arrive within 30 minutes of the agreed pickup time (or 60 minutes for airport/train station pickups). No-show rides must be paid in full, though waiting time surcharges will not apply.

(B) Hourly Bookings: A no-show occurs if the user/guest is not present by the end of the booked hours. The user remains fully liable.

4.7 BEHAVIOR IN THE VEHICLE

Guests must follow road traffic rules, including wearing seat belts. The TSP’s instructions must always be followed.

Smoking is prohibited. If ignored, the user will bear cleaning costs and any service downtime losses.

Food consumption is discouraged. Alcoholic beverages require prior TSP approval.

5. REMUNERATION AND PAYMENT

5.1 GENERAL PRINCIPLES

The booking confirmation specifies Airportblacklane’s compensation, influenced by vehicle class, route, advance booking period, pickup time, and location.

Special requests (e.g., multilingual chauffeurs, child seats, extra stops) may increase the price.

5.2 RIDE CHANGES

Users or guests may modify rides post-booking, subject to TSP feasibility.

Upgrades or additional services (extra distance or time) will be charged per the applicable price schedule. Charges are rounded up to the nearest half-hour for hourly bookings.

If the ride is shortened, the original price remains unchanged.

5.3 OTHER CHARGES

5.3.1 WAITING TIMES FOR TRANSFER RIDES

  • No waiting surcharges apply for up to 60 minutes at airports or train stations.
  • No surcharges apply for up to 15 minutes elsewhere.
  • Extra waiting time is charged per-minute based on hourly booking rates.

5.3.2 ADDITIONAL KILOMETERS FOR HOURLY BOOKINGS

Hourly bookings include a specified number of kilometers per hour. Extra distance is billed separately per local pricing, plus tax.

5.4 PAYMENT METHODS

Payments can be made via credit card (fees covered by Airportblacklane). Bank transfers may incur transaction fees borne by the user.

5.5 INVOICES, DUE DATES

Invoices are available electronically. Credit card payments are due immediately; bank transfer payments follow the invoice terms.

5.6 LIABILITY

Airportblacklane is liable for damages caused by intent or gross negligence. TSPs and chauffeurs are not Airportblacklane’s agents but independent providers.

9. FINAL PROVISIONS

9.1 ENTIRE AGREEMENT, WRITTEN FORM

These terms constitute the full agreement. Amendments require written form.

9.2 OFFSET, RETENTION, AND ASSIGNMENT

Users may offset claims only if legally established or undisputed. Rights under this contract cannot be assigned without written consent.

9.3 APPLICABLE LAW, JURISDICTION

German law applies. The place of fulfillment and jurisdiction is Berlin, unless legal provisions dictate otherwise.

9.4 ONLINE DISPUTE RESOLUTION

The EU provides an online dispute resolution platform at ec.europa.eu/consumers/odr. Airportblacklane does not participate in arbitration proceedings.

9.5 SEVERABILITY CLAUSE

If any provision is invalid, the remainder remains in effect.

The EU Commission has an Internet platform for the online settlement of disputes (referred to as the "OS platform"). The OS platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts or online service contracts. You can reach the OS platform through the following link: ec.europa.eu/consumers/odr.

AirportBlacklane is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9.5 SEVERABILITY CLAUSE
Should individual provisions of these T&Cs be or become ineffective, unenforceable or contain gaps, the remaining regulations will remain effective. The parties undertake to replace the ineffective, unenforceable or missing provisions with those that most closely approximate the meaning and economic purpose as intended by the parties.
